Robert has more than 20 years experience conducting litigation in state and federal courts, including as advocate.
He acts for and advises high networth individuals, Liquidators and Trustees, financial firms, and SMEs in relation to corporate insolvency, bankruptcy, personal and corporate structuring, complex commercial disputes, corporate governance and international class action litigation.
In the insolvency sphere, Robert has acted for insolvency practitioners in claims involving insolvent trading, voidable transactions and conducted public examinations and forensic investigations into insolvent companies. He has also acted for directors of insolvent companies to mitigate their personal risk, advising them in relation to voluntary administration, deeds of company arrangement and safe harbour options as well as protecting their personal interests by defending claims by liquidators and statutory demands from creditors.
Robert acts for and advises financial service firms, including AFS licensees on compliance with regulations including AML/CTF regulatory requirements, disclosure obligations, dealing with government regulators, risk management, due diligence, privacy legislation and general AFS licence obligations. He represents clients in proceedings in AFCA and the AAT. He assists in drafting and advises in relation to compliance plans, disclosure documents and financial services guides.
In addition to providing advice to financial firms, Robert has also sat on the boards of AFS Licence holders, acted as a compliance committee member and held the position of responsible manager for financial firms. His practical experience in these roles mean that Robert allows him to understand the needs of a client from their point of view.
In general commercial litigation, Robert has acted for client in highly complex and technical matters in litigation against the ATO, shareholder oppression actions, matters involving complex fraud, professional negligence and partnership disputes. Robert is praised by his clients for his approachable manner and ability to provide advice on complex legal matters in a way that is understandable for those without a legal background.
His focus is on achieving timely, commercial and cost effective outcomes based on the individual requirements of his clients.
